Under the Clarity Act, every digital asset will fall into one of three categories:
- Digital commodities, which are to be overseen by the Commodity Futures Trading Commission (CFTC)
- Investment contract assets, which stay with the SEC
- Permitted payment stablecoins, which fall under banking regulators per last year’s Genius Act, with the SEC and CFTC retaining anti-fraud authority over stablecoin trades on their registered venues
In that framework, tokens whose value derives from a sufficiently decentralized blockchain qualify as commodities, while tokens sold through investment contracts to fund development qualify as securities.
Adding The regulations will propose 2 Agency that will handle the new type of Assets
Regulatory Division: The act proposes to split regulatory oversight between two major agencies:
Commodity Futures Trading Commission (CFTC): Would have exclusive jurisdiction over spot markets in “digital commodities.”
Securities and Exchange Commission (SEC): Would oversee assets classified as “investment contract assets.”
Market Structure Rules: The CLARITY Act aims to create new market-structure rules for exchanges, brokers, and blockchain networks, ensuring that they operate under a consistent regulatory framework.
Consumer Protections: It includes provisions to protect consumers and promote innovation within the digital asset
It will be a good win and promise of stabilizing the Crypto currency market and reduce the risks , which will attract more investor that will come because of the clear regulations and ( stable markets – not up and down so quickly and less risk in investments )
